Board of Appeals · Meeting of October 28, 2026

MILLBURY — The Millbury Board of Appeals unanimously approved a package of zoning variances allowing demolition and rebuilding of a two-family home at 2-4 Howe Avenue. Attorney Don O'Neill, representing applicant Dillon and Taylor LLC, said separating the property's commercial garage from its residential structure would resolve financing problems, since "you can't get financing for a residential building if you've got a repair garage on the same lot." The board granted relief from the 12,500-square-foot minimum lot area, conditioned on the new residential lot reaching at least 5,000 square feet while keeping building coverage at or below 30 percent, plus setback relief of 3.9 feet in the rear, 21.6 feet on Howe Avenue, and 11.1 feet on Canal Street. A Canal Street porch must remain open-air under the approval.

Abutters Mark and Marlene Millette raised safety concerns about power lines and sight lines, though board members said those fall under National Grid and MassDOT jurisdiction. The board separately voted to allow electronic signatures on future decisions under Massachusetts General Law Chapter 110G.
